Terms of Service

1. Purpose

These Terms of Service (the "Terms") govern the use of the StockAInalyst platform, accessible at stockainalyst.com (the "Service"), operated by Clement HOURSEAU, micro-entrepreneur, SIRET 51005243400048, headquartered at 21 rue Pierre Gagnaire, 45340 Boiscommun, France (the "Publisher"). By creating an account or using the Service, you agree to be bound by these Terms.

2. Definitions

• Service: The StockAInalyst web platform and all associated features.
• User: Any natural person who creates an account on the platform.
• Analysis: An AI-generated financial report produced by the Service from a document uploaded by the User or from the Analysis Library.
• Document: Any file uploaded by the User for analysis (PDF, HTML).
• Credit: A unit that allows the User to request the generation of one analysis.
• Subscription: A recurring plan (monthly or annual) granting specific features and pricing.
• Premium Subscription: An optional add-on subscription granting access to premium tools (Semantic Analysis, Divergence Detector, Investment Notebook, Track Record).
• Analysis Library (Analysotheque): A catalog of pre-analyzed reference companies available for instant purchase.
• Portfolio: A personal collection of tracked companies with aggregated scores and radar views.

3. Account Creation

To use the Service, you must create an account using a valid email address. You must be at least 18 years old. You agree to provide accurate and complete information and to keep it up to date. One account per person is allowed. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4. Description of the Service

StockAInalyst is a B2C SaaS platform that uses artificial intelligence to analyze corporate financial documents (annual reports, quarterly results). The Service includes: uploading documents and generating AI-powered analysis reports across 6 dimensions (Financial Health, Risk Assessment, Growth Drivers, Capital Allocation, Valuation, Rating); browsing and purchasing analyses from the Analysis Library; managing investment portfolios with aggregated scores; accessing premium tools including Semantic Analysis, Divergence Detector, Investment Notebook, and Track Record (subject to Premium Subscription); comparing companies side by side; and browsing the public Screener.

5. Subscription Plans

The Service offers the following subscription plans:

• Decouverte (Free): Default plan. Access to 3 demo analyses, unlimited active companies, one-shot credit purchase at 5 EUR per analysis. No portfolio, no Analysis Library access.
• Basic (2.90 EUR/month or 31.30 EUR/year): One-shot credits at 4 EUR per analysis, up to 10 active companies, 1 portfolio, Analysis Library access.
• Plus (9.90 EUR/month or 106.90 EUR/year): 1 included analysis per month, one-shot credits at 3 EUR, up to 30 active companies, 2 portfolios, Analysis Library access, aggregated dashboard.
• Premium (19.90 EUR/month or 214.90 EUR/year): 2 included analyses per month, one-shot credits at 2 EUR, unlimited active companies, unlimited portfolios, Analysis Library access, aggregated dashboard.

All prices are in EUR and include applicable taxes. Annual plans offer approximately 10% discount. Pricing may be updated with 30 days' prior notice to active subscribers.

6. Premium Subscription

In addition to the base subscription plans, the Service offers a Premium Subscription (14.90 EUR/month or 149 EUR/year) that grants access to premium analytical tools: Semantic Analysis (management discourse tracking), Divergence Detector (sentiment vs. financial performance), Investment Notebook (structured thesis and notes), and Track Record (thesis publication and resolution tracking). The Premium Subscription is independent from base plans and may be subscribed to alongside any plan. Future premium tools will be added to this subscription at no additional cost.

7. Credits and Quotas

Subscription credits (included analyses) reset monthly on the anniversary date of the subscription, not on the first of the month. Unused subscription credits do not carry over. One-shot credits are purchased individually, do not expire, and are consumed in FIFO order (first purchased, first used). When generating an analysis, subscription credits are consumed first; one-shot credits are used only when subscription credits are exhausted.

8. Payment and Billing

Payments are processed securely by Stripe. Accepted payment methods: credit card, debit card. Subscriptions are billed monthly or annually depending on the chosen plan. All amounts are in EUR. Invoices are available through the Stripe Customer Portal. Refunds for unused one-shot credits may be requested within 48 hours of purchase, provided the credit has not been consumed.

9. License and Rights of Use

The Service grants you a personal, non-exclusive, non-transferable, revocable license to access and use the analyses, tools, and features of the platform for your own personal, non-commercial purposes. This license does not transfer any ownership rights.

10. Prohibition of Redistribution

It is strictly prohibited to: share, redistribute, resell, sublicense, publish, or make available to third parties, in any form, any analysis, report, data, or content generated by StockAInalyst.

This includes, without limitation: copying analyses into external publications, sharing screenshots or exports on social media or forums, providing access to your account to third parties, or using StockAInalyst outputs in paid or free services, newsletters, or reports intended for third parties.

The public Track Record feature allows Users to publish their own thesis statements and resolution outcomes. This constitutes the only authorized form of public sharing, limited to the User's own theses.

All content generated by StockAInalyst (charts, tables, analysis reports) includes a digital watermark bearing the mention "StockAInalyst.com" to protect intellectual property.

An identifier linked to the User's account is also embedded in the generated content for traceability purposes. This identifier contributes to the traceability of any unauthorized redistribution.

Any violation of this article may result in immediate and permanent termination of the User's account without refund, and may give rise to legal action for damages.

11. AI-Generated Content: Limitations and Liability

The analyses, scores, semantic insights, cross-reference results, thesis resolutions, and all other outputs produced by the Service are generated by artificial intelligence models. These outputs are provided for informational purposes only.

AI-generated content may contain errors, inaccuracies, hallucinations, or omissions. The AI models may misinterpret financial data, produce incorrect calculations, or draw flawed conclusions. Analyses do not reflect real-time market conditions or events occurring after the analyzed document was published.

The User acknowledges that AI outputs should be treated as one input among many in their own research process, and should never be relied upon as the sole basis for any financial decision.

StockAInalyst makes no guarantee regarding the accuracy, completeness, timeliness, or fitness for any particular purpose of any AI-generated content.

12. Not Investment Advice

StockAInalyst does NOT provide investment advice, financial advice, tax advice, legal advice, or any recommendation to buy, sell, or hold securities or financial instruments. The Service is a research assistance tool, not a financial advisory service. The User is solely and entirely responsible for their own investment decisions. StockAInalyst is not registered with or regulated by the AMF (Autorite des Marches Financiers), is not a CIF (Conseiller en Investissements Financiers), is not a PSI (Prestataire de Services d'Investissement), and is not supervised by any financial regulatory authority.

13. Intellectual Property

The StockAInalyst platform, its source code, design, branding, and all AI-generated content are the exclusive intellectual property of the Publisher.

Documents uploaded by Users remain the property of their respective authors or rights holders. The User warrants that they have the right to upload any document submitted to the Service.

The User grants StockAInalyst a limited, non-exclusive license to process uploaded documents solely for the purpose of generating analyses. This license terminates upon account deletion.

Content created by the User within the Service (thesis statements, notes, portfolio configurations) remains the User's intellectual property.

14. Liability and Warranties

The Service is provided "as is" and "as available" without any warranty, express or implied, of accuracy, completeness, availability, or fitness for any particular purpose.

StockAInalyst shall not be liable for: any investment decision made based on its analyses or outputs; any direct or indirect loss, including financial loss, resulting from the use of the Service; temporary unavailability of the Service due to maintenance or technical issues; actions of third-party service providers (Stripe, Cloudflare, Google Cloud).

In all cases, the total aggregate liability of StockAInalyst shall be limited to the amounts actually paid by the User to StockAInalyst during the twelve (12) months preceding the event giving rise to the claim.

15. Termination

The User may cancel their subscription and terminate their account at any time from the Settings page. StockAInalyst reserves the right to suspend or terminate any account that violates these Terms, without prior notice and without refund. Upon termination, the User loses access to all features, analyses, and data associated with their account, subject to the grace period described in Article 16.

16. Account Deletion

Account deletion can be requested from Settings. A 30-day grace period allows the User to cancel the deletion request. After the grace period, all personal data, uploaded documents, analyses, portfolios, and notebook entries are permanently and irreversibly deleted. Active subscriptions are automatically cancelled upon deletion. Payment records are retained for 10 years in compliance with French legal requirements.

17. Modification of Terms

StockAInalyst reserves the right to modify these Terms at any time. Users will be notified by email at least 30 days before significant changes take effect. Continued use of the Service after the effective date of the modified Terms constitutes acceptance. If a User does not agree with the modified Terms, they may terminate their account before the effective date.
